Kerala High Court stays single judge's order

The Kerala High Court stayed a single judge's order permitting the Muthoot Hotels Private Ltd at Kovalam to put up temporary fence in their property built on encroached government land.

The order in this regard was issued by a Division Bench, comprising Chief Justice H L Dathu and Justice K T Sankaran, on an appeal filed by the government challenging the single judge's order.

Earlier, a single judge had directed the Thiruvananthapuram District Collector to permit Muthoot to put up temporary fencing in the property.

The case relates to the land conservancy proceedings against Muthoot Hotels.

According to the government, the petitioners had encroached about 6.60 acres of government property and land conservancy proceedings were initiated against them.Muthoot refused to vacate the property even after notice was issued on July 25 last year.On February 24 this year, the government demolished the structure and took possession of government land which was challenged by the petitioner.
