Paytm Says Supreme Court Stays Rs5,712-Cr GST Notice Sent to First Games

New Delhi — In a significant relief for the digital payments company Paytm and its customers, it has learned that the Supreme Court of India has delayed a Rs5,712 million tax on goods and services (GST) Demand notice which was previously sent to its gaming division, First Games. This notice led to an intense debate in the Indian online gaming and fintech industries, will be held until further court process.

Legal Relief Amidst Regulatory Heat

Paytm confirmed the news in a regulatory filing Friday, noting it was notified that Supreme Court granted a temporary stay on the tax demand that was issued by the Directorate General of GST Intelligence (DGGI) had placed to First Games for alleged tax fraud.

 “We welcome the Supreme Court’s interim relief and remain fully compliant with all legal and tax obligations,” an official Paytm spokesperson stated.

The court hasn’t yet made a decision on the legality in GST claims. GST claim, however the stay offers the court with a temporary shield against enforcement action.

Industry Implications: A Precedent in the Making?

Legal experts believe that this stay could create a precedent other tech and gaming platforms which are awaiting identical GST notices. This is because the Indian online gaming industry is under scrutiny since the month of July 2023 as new regulations imposed the tax rate of 28% on games that are real money which has drawn harsh criticism from the industry’s stakeholders.

 “This case could influence how indirect taxation is interpreted for online services,” said Rajiv Mehra who is a tax lawyer.
